Right of withdrawal

Consumers within the meaning of the Consumer Protection Act (KSchG) have the right to withdraw from the distance selling contract within fourteen days without giving any reasons. The withdrawal period is fourteen days from the day on which the consumer or a third party designated by the consumer, who is not the carrier, has taken possession of the goods. In the case of partial deliveries, the withdrawal period begins with the receipt of the last partial delivery. To exercise the right of withdrawal, the consumer must inform Xplore Commerce GmbH, Höllgrund 3, 8083 St. Stefan im Rosental, email: [email protected], by means of a clear statement regarding the decision to withdraw from the contract. The provided sample withdrawal form can be used for this purpose, but is not mandatory. To comply with the withdrawal period, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the withdrawal period expires.

Consequences of withdrawal

If the consumer withdraws from this contract, Jack must reimburse all payments received from the consumer, including delivery costs (except for additional costs resulting from the consumer choosing a different type of delivery than the cheapest standard delivery offered by Jack), without delay and at the latest within fourteen days. For this reimbursement, Jack uses the same payment method that the consumer used for the original transaction. The consumer will not be charged any fees for this reimbursement.

Jack may refuse the refund until Jack has received the goods back or until the consumer has provided proof that he has returned the goods.

Return of the goods

The consumer must return the goods immediately and in any case no later than fourteen days from the day on which he has informed Jack of the cancellation. The consumer bears the direct costs of returning the goods.

Exclusion of the right of withdrawal

The right of withdrawal does not exist for contracts concerning: goods that are made to customer specifications or are clearly tailored to the personal needs of the consumer; print-on-demand products that are individually produced only after ordering (§ 18 Abs. 1 Z 3 FAGG).

Entrepreneur

Entrepreneurs within the meaning of the Commercial Code (UGB) do not have a right of withdrawal.
